Privacy policy

This Privacy Policy explains what personal data FAIRmark LLC ("FAIRmark", "we", "us") collects and how we use it. A defining feature of FAIRmark matters here: the software is fully offline. This policy is therefore mostly about our website and the purchase process — not about the application, which does not send us your data.

1. The software collects nothing

The FAIRmark desktop application runs entirely on your computer. It makes no network calls and transmits no drawings, inspection data, project content, or telemetry to us or anyone else. Your engineering data never reaches us. Licence activation involves a Machine ID (a non-reversible identifier derived from your computer) and your order details, which you provide to us to receive a licence — see section 4.

2. Data we collect via the website

Our website is hosted on Cloudflare. Standard server logs (such as IP address, browser type, and pages requested) may be processed to serve and secure the site. We do not use analytics or advertising cookies. If this ever changes we will update this policy and, where required, ask for your consent first.

3. Payments (Paddle, our Merchant of Record)

Purchases are processed by Paddle, our authorised reseller and Merchant of Record. Paddle collects and processes your payment information as the seller of record, under its own privacy policy (available at paddle.com). We do not receive or store your full payment card details. Paddle shares with us the order information we need to deliver and support your licence.

4. How we use your data

We do not sell your personal data, and we do not use your data for third-party advertising.

5. Email delivery and hosting providers

We use a small number of processors to run the business: Cloudflare (website and storage hosting), Paddle (payments / Merchant of Record), Google Workspace (our business email), and Resend (sending transactional email). Each processes data only as needed to provide its service.

6. Retention

We keep enquiry and order records for as long as needed to support you and to meet legal and tax obligations, then delete or anonymise them. Licence and order records are typically kept for the life of the licence plus any period required by law.

7. Your rights

Depending on where you live (for example, under the GDPR in the EU/UK or the CCPA/CPRA in California), you may have rights to access, correct, delete, or port your personal data, and to object to or restrict certain processing. To exercise any of these, email support@getfairmark.net and we will respond as required by applicable law. You may also complain to your local data-protection authority.

8. International transfers

We and our providers are based in or use infrastructure in the United States and other countries. Where your data is transferred internationally, we rely on our providers' lawful transfer mechanisms.

9. Children

FAIRmark is a professional engineering tool and is not directed to children. We do not knowingly collect data from anyone under 16.

10. Changes

We may update this policy; the effective date above will change and material updates will be noted on this page.
